The applicant specifically warrants and represents to Truffle Imports Ltd. that all goods and services that it acquires under this agreement are acquired for the purpose of a business and that section 42(2) of the Consumer Guarantees Act applies.

I/We hereby apply to open a ‘20th of the month’ credit account and offer to purchase goods upon the terms set forth in this application and conditions of sale and confirm that all the information supplied on this form is true and correct.

I/We further authorise any person or company to provide you with such information as you any require in response to this credit application. I/We further authorise you to furnish to any third party details of this application and any subsequent dealings that I/We may have with you as a result of this application being actioned by you.

It is to be noted that until the total cost of the transaction and all other monies which may become payable by the Buyer to the Seller under this agreement have been paid:

• a) Property (ownership) in the goods shall not pass to the buyer.
• b) The Buyer shall notify the seller within 24 hours if the goods are seized or taken out of the Buyers possession for any reason whatsoever, giving full particulars and the address (if known) to which the goods have been removed.
• c) Once despatched perishable goods are non-returnable.

Recoverable costs: I/We agree to indemnify you against all costs, whether commission, legal fees or debt recovery fees incurred by you or your duly authorised agents relating to any monies, goods or services that may be outstanding from time to time pursuant to the terms of this agreement.
